New policy may shut down small businesses in Wine Country

The county is creating a policy that may shut down some small businesses in Temecula’s Wine Country.

The county has designed an amendment to change the Citrus/Vineyard Rural Policy Area’s plan – which is part of the Southwest Area Plan, itself part of the larger Riverside County Integrated Plan – to require home owners operating "special events facilities" to sit on 10 acres, rather than the five required previously.

The amendment aims to prevent urbanization of the area and preserve its wine and citrus growing industries, according to Derek Hull, a principal planner with the County of Riverside.

Nonetheless, the amendment discriminates against small businesses and eliminates competition for local wineries, according to some business owners in the region.

The amendment will affect the 11.8 square miles local residents refer to as "Temecula’s Wine Country," though the area sits on county land outside Temecula’s limits.

A public hearing on the proposed amendment is planned for July 23.

The Wine Country is home to more than 20 wineries and numerous smaller businesses, such as houses that serve as bed and breakfasts for tourists, ranches that offer horseback riding lessons, hot air balloon companies which launch and land in open fields and special events facilities which serve as places to hold weddings and reunions, according to local business owners.

Trouble for small businesses

"It’s very unfair to the business owner," Eileen Rivard, a Wine Country resident, said of the plan amendment.

Rivard is a professional wedding planner who hosts ceremonies and receptions at her home.

Her home – which she calls Villa de Amore – sits on Calle Cabernet, a dirt road which winds through patches of desert brush and vineyards before climbing a tall hill.

From the crest of that hill, Villa de Amore peeks out from what looks like an ocean of green.

Rivard fears the plan amendment will close Villa de Amore down because it sits on only five acres.

"I’m a single mom putting three kids through college," she said. "I have no career to go back to. It will be devastating [if the county approves the amendment]. My whole future will be down the tubes."

On June 28, Rivard hosted the kind of event she fears the county will ban. More than 100 people dressed in suits and evening gowns sat in rows of white folding chairs in her home’s courtyard.

Though people were chatting and a woman was singing through a public address system, the event was hardly audible from the parking area less than 150 feet from the courtyard.

The county has no reason to oppose what was taking place on her property that day, she said, standing in front of her home while a young couple took their vows behind her.

The plan amendment favors big businesses by barring their smaller competitors, said Leah DiBernardo, a Wine Country resident.

"This ordinance will affect small businesses and I’m very concerned with that," she said.

In 2004, DiBernardo and her family built a house on Rancho California Rd. and opened The Castle Bed and Breakfast, she said.

Though The Castle has been operating as a bed and breakfast ever since, she is still in the process of getting her plot plan approved.

"They told us we could operate as long as we were working on bringing [The Castle] into compliance," she said.

Additionally, the planning department told DiBernardo she could hold special events as long as fewer than 200 people attended.

She had been following the county’s directions and everything had gone fairly smoothly until recently, she said.

A county staff member she declined to name told her the proposed amendment would derail her business plans.

"As business owners you move forward based on what your government – in whom you put your trust – tells you," she said. "You spend thousands and thousands of dollars and then they Advertisement

turn around and tell you something different."

The amendment will have no effect on bed and breakfasts, according to Hull.

Origin of the amendment

Though the amendment will affect the entire region, Villa de Amore provoked the plan amendment’s creation, Hull said.

After the county amended the Citrus/Vineyard Rural Policy Area’s plan for the first time in 2006 the Planning Commission reviewed Rivard’s plot plan.

The plot plan delineated Rivard’s business activities and included a layout of her property.

The amendment barred all commercial activity in the region unless 75 percent of the property on which the business took place was dedicated to agriculture.

Commercial uses, such as day spas, bed and breakfasts and special occasion facilities, were "permitted only when they are secondary, and directly related, to the agricultural operations," according to county records.

The county allowed wineries to conduct these other businesses so wineries would have more than one way to make money, according to the amendment.

"The intent of allowing limited incidental commercial use is to provide economic viability to the primary vineyard and winery operations," it stated.

Therefore, the county instructed Rivard to make several changes, including tearing out almost four acres of olive trees and replace them with vineyards.

"I met zoning. I met every one of their requirements," she said.

Notwithstanding, Villa de Amore was causing noise and parking problems and the county received some complaints, Hull said.

Thus, the county’s Planning Commission denied her plot plan in June 2007, according to county records. Rivard appealed the decision but the County Board of Supervisors upheld the Planning Commission’s decision.

Last fall, Supervisor Jeff Stone instructed the planning department to create a plan amendment that would require such a facility to sit on more acreage, Hull said.

The county hoped more acreage would buffer neighbors from the noise and traffic these events cause, he said.

In addition, the amendment aimed to preserve winemaking as the region’s primary function, Hull said.

Other businesses, such as Villa de Amore, pose a threat to winemaking, he said.

"The problem comes when the intent of the Wine Country is threatened by these [other] uses," he said. "So we don’t lose the intent of the area we had to make stricter regulations."

This plan amendment is only the latest problem Rivard has had with the county, she said.

Rivard built Villa de Amore in 2002 to realize her dream of being a wedding planner, she said. Before building the house she went to the county for guidance numerous times.

According to her, county officials gave her the unofficial "go-ahead" and she built the home and started her business based on their guidance.

Her business was going so well she quit her job in the financial department of a local automobile retailer and became a full-time wedding planner, she said.

To date, Rivard has invested nearly $2 million in her home and business, she said.

Last May, after Rivard refused to stop the events, the county filed an injunction to close down her business.

She took her case to court and this time, she won.

"It seems as if the county’s trying to get [Rivard] to stop doing that which you allow the wineries to do. That didn’t seem quite right to me," Judge Michael B. Donner told Lisa Traczyk, the county’s attorney, according to the June 4 trial’s transcripts.

Traczyk told the judge Rivard’s facility creates dust and noise and is a nuisance. Judge Donner responded by saying similar events at a winery would have the same negative side effects.

The judge denied the county the right to close down Villa de Amore. If the proposed amendment is approved, however, she may face another costly court battle, Rivard said.

Some business owners in the affected region have suggested that the amendment shows favoritism for big businesses and campaign contributors to Jeff Stone, the region’s County Supervisor.

The County has bought brand new trucks, hired additional code enforcement officers, and started busting 100 year old ranches to bring codes up to date. I'm talking about way out in the country. They want the land. The wine country hustle falls right in line with the way Stone does business.

Of course the city of Temecula does not like this facility - they cater to the old winery grower crowd and bend to their will. No talk about how many DUI's the WineFest creates or the DUI's every weekend from all the wineries put together. Someone choses to do something other than wine on "their" turf and they get the CC to make it as difficult as possible. If I was an investigative reporter, I'd look into what large wineries have looked at acquiring her land in the recent past - follow the money.

I hope she prevails....

The county and Stone's office do not have the wine country's best interest in mind. Perhaps the one group worse than the county and its elected officials is the group of apathetic residents and businesses too lazy or afraid to get and stay involved. If we don't make our voices heard in large and unending waves, all we'll end up hearing is the occasional news story of a resident's or small business's plight! Yes, she should prevail, and if she does not, I hope there is sufficient backlash to expose the county corruption that's been feathering many caps!

Our 64 parcels of lands are 5 acres between Anza Rd. and Calle Contento. It is part of our deed that small rural businesses like a feed store, car repair, etc., horse back riding, etc. can legall be done on our properties. Not permitted are pig farms or chicken farms.
Stone has NO right to alter the value of our lands or their deeded constitutional rights.
Remember to show up for this hearing. As if you do not protest in writing and in person what the County Supervisors or the City Council Members of Temecula are voting into law and changing, THEN YOUR SILENCE BY LAW MEANS YOU AGREE WITH WHAT THEY ARE DOING TO YOU.

For over four years Stone has allowed a property owner living in Glen Oaks to run professional dirt bike racing and jumping which is illegal on large parcels.
They advertise on the Internet to come pay and ride ratical motorcycle riding.
No one will close these people down.

What this article brings forth is Villa de Amore's side of the story. It almost looks like a paid image piece, not a researched and balanced news story. I didn't see any attempt in here to interview the neighbors of the villa! The neighbors that have to put up with this ongoing nusiance! This place is such a bad neighbor, and just keeps covering it up with lies like this article! The board of Sups and Mr. Stone have tried to do its job and uphold the laws that are on the books. Unfortunately its hands are tied as the County must follow the law. Ms. Rivard does not! This place doesn't belong up in a residential neighborhood. It should be down with the wineries on a 10 acre parcel. I commend our board for trying to do the right thing. I commend our Code Enforcement folks for trying to do the right thing. Its unfortunate that this property owner (who started as an artist retreat, not a wedding venue) is forcing this whole thing into court. Hopefully then the neighbors who have had to put up with this illegal bootleg business being run out of a residence will finally be heard. What about our property rights? What about how the noise and traffic affect us? The whole quote about sound from a singer being barely audible at 150 feet is complete BS I live numerous acres away and the sound blows me away. It sounded like the rose bowl up there last weekend. The sooner this place gets shut down and sold back into a single family residence the better!

I can understand both sides of this story but let's not forget about the brides who have already paid and have reserved this place for their wedding. It is no fault of theirs if they were not told this venue was in trouble, some of them have reserved the space over a year ago. It's one thing to stop new brides from reserving the venue but to shut Villa down immediately would really ruin the dream weddings that so many couples have already spent time and money to plan.

When you boil it all away, it is still a attempt to bypass a favorable judgement for Villa De Amour and a court defeat for the County The Wine Growers Assoc., for the first time, endorsed a candadate for reelection to The Supervisorial Post Jeff Stone. That is their right, but it kinda smells when that now elected Surpervisor, tries to run through a ordinance that circumvents that very Court decision. It looks like a not so subtle payback for that support. This seems to be a beauracratic tap dances to run people out of the time and the money to defend themselves.

Holding this meeting at 10 am is a way of damping the opposition. Many people work for a living and will not be able to get there at that hour. Will the Riverside planning Commission pay for our gas? Hold it in Wine Country at a hour that is convenient for regular people not just County Officials. I will repeat. As another planned wedding facility that was shut out by the county, Eileen Rivard has my heartfelt sympathies. I spent a year looking for and finally purchasing 5 acres in wine country specifically for "special events". I spoke to the county twice before purchasing and was also given the unofficial approval. Last fall, a year and a half and more then $600K later, continuing contact with the county revealed their intent to increase acreage requirements. My conversation with Jeff Stones office included comments of "the county has the right to change their mind" and "I don't know what to tell you". I was told it would be impossible to approve my project under any circumstances.

Sounds to me like the small busines owners and potential busines owners should unite and stand our ground against lawmakers like Jeff Stone who I'll bet have shady side dealings with wealthy winery owners.

When did American citizens lose their right to entreprenaurship by following the law?

Anyone want to carpool to the Commission"s public hearing??

Getting the facts straight, Eilene Rivard already went to Court and won. The Counties case was called unwarented. I,personally, in reading your rant, do not believe you live anywhere near the Ville De Amour. I would suppose if a resident lived near a ten acre winery there would be" legal" noise dust and problems. Five acre noise is deemed illegal by our fearless leader, Stone. Then we can talk about the DUIs and assorted tipsy wine drinkers staggering through the area. Using your logic, not mine, we probably need to get rid of the large wineries.

Last December, some people got together and had meetings about "visioning" for the wine country. This can be googled. The "players in attendance: RANCON, Chuck Washington, (connected to Rancon), Jeff Stone, (connected to Rancon and others. The name of the game is "kill the competition" and thats what is happening. Callaway winery tried to build a project on THEIR OWN PROPERTY, and were shut down by the City of Temecula and the County, only to then approve a similar project for Rancon ON THE SAME PROPERTY. So Temecula officials and County officials shut down Callaways project, then allow Rancons project, THEN THEY PERSONALLY INVEST IN THE PROJECT! I am not making this stuff up! google it! It's time for the citizens of Temecula and the Wine Country to organize against this developer machine that is being protected and driven by the Temecula City Council and the County Board of Supervisors. Lets find out why Jeff Stone and the Temecula City Council are so interested in Temecula Wine Country. (?????)

Dear get your facts straight; In the case of villa de amore, Eilene Rivard has not went to court an won! The court battle has not even begun! Her most recent day in court was simply a hearing to determine if she could continue operation until the trial in Dec or Jan. The judge granted her the ability to continue operation of previously scheduled weddings through Oct. 08. What she "won" was a stay of execution. The county put forth injunction on behalf of the neighbors that have been forced to live with this ongoing nuisance in the hope of relief until the trial. The judge even stated that he knew the legal premise was wrong for her to continue operating, but personally felt greater harm would come to the brides who could not have their weddings that have allegedly been planned for over a year and the subsequent monetary repercussions to Ms. Rivard. So now the immediate neighbors of the villa get to endure another year of traffic, noise, DJs, and drunken wedding-goers in our neighborhood. But come Jan 09, Ms. Rivard will get to look all her immediate neighbors in the eye, and be accountable for ruining our weekends for the past 3+ years. For wasting our time to sick the big bad county on her. Yes, I am an immediate neighbor. You, obviously are not! Probably one of the minions who signed her little petition because it doesn't affect you, or she smiled and played nice nice to get you on "her" side. Good for you, guess what, if you lived where I do, you would feel differently, so yes, being 5 acres away or 10 acres away does affect me, having the businesses away from the homes does effect me, and I will fight to the end, and maybe beyond to protect MY property rights and to restore peace and quiet to MY neighborhood. To whinecountry...get a life....I too live w/in 5 acres of Villa de Amore and I have more noise problems w/Falkner and Longshadow than I do w/Villa de Amore....perhaps you are a tad confused as to where the noise is coming from....on some Saturdays you can hear music and Villa de Amore is NOT having an event...check your facts...

The RCIP legal process of notifying all property owners within the 11.5 square miles of their intent by amendment to change the usage of our lands and their value has been breeched/violated.
Supervisors and their Planning Commissioners DID NOT USE the County of Riverside's Assessor's Offices Offical Mailing Lists and the US mail to notify us that THEY are intending to BREAK the Eight YEAR sealing of Zoning terms in the General Plan in Southwest Wine Country.
They DO NOT HAVE THE RIGHTS to use discrimination of larger property land ownership OVER smaller parcelled lands.
Plus, they know that the elimination of agricultural water is NOW NOT Available for new vineyards, as of Jan 1, 2008 both the State MWD Sacramento Delta water has been cut 30% to start with and that the 60 percent of the 2003's Colorado River Water Alotment NOW also has been reduced AGAIN...to local farmers and land owners.
THERE IS NO PAPER WATER HERE, folks. The CA State Supreme Court Ruling in 2002 states that you can not add more residential developer housing when the water is no longer adequate for the projected growth the Supervisors intent WANTS as do the Bonus Points being lost to Developers' profits IF....Paper Water is NOT ALLOWED.
Its a 60 year drought. And...the State of Colorado in one more year will be taking millions of acreage feet of water out of the river in their Newly Being Built Haystack Hydro Pipe Pumping Pipeling throughout their entire state. No dams will be needed to give them the water they need and/or want.
Our agricultural watering will soon be extinct.
So, knowing this, why are Supervisors changing the zoning to Larger parcel ownership of 10 acres only.

notawhiner: Unlike you, I do go outside, in the evenings and weekends. I too hear Longshadow and Falkners, but they are off in the distance where they belong - in a properly sized and zoned area. As for facts, I know when the villa is hosting an event, I count the cars, I see the lights, I see the bride and groom! I even know the DJ's playlist! I am more than done with all of it! As for Longshadow and Falkners, their traffic does not come up into our narrower residential neighborhood. They are far enough away as to not impact us. I do not have a problem with them. They are wineries, located on huge parcels of land, surrounded by their vinyards. If the villa was down there, I could care less about it as well. This is what the 10 acre plan is all about. Keeping business zones (wineries and such) isolated from residential zones. If I was dumb enough to try and live on calle contento, or RC road. I would have nobody to blame for the noise and traffic. But that is not the case where we live. We have someone trying to run a full scale events venue on a property no bigger than the ones your and my houses sit on. That simply is not enough buffer for the activities, noise and problems created by these venues. This measure has nothing to do with being anti-small business. It has to do with keeping big business out of residential neighborhoods and smaller unbuffered property zones. I do not own a business, nor do I wish to live in a commercial zone. I purchased in a rural residential zone, it needs to be kept that way!

All this is really unnecessary....if you just go to the County web site & into the minutes of the last few years, these meetings, you can follow from start to finish, from marriage to divorce, and probably more than you bargained for, some of the happenings at some of these events, just what is *and what we hope will never be*at least in the neighborhood. Why do you think it has been denied thus far, it's not picking on poor Ms Rivard, (you can trust**shes not poor) *you have been scammed* my goodness, Villa De Amore has not won anything..the couples are entitled to their day they have planned & paid for..it's not their fault they fell into something they honestly thought was legit..&..The Judge was being respectful to what was in the process, But she did say under oath, there were no more scheduled after October 2008. thats in there too. There is still a fight for our quality of life & we deserve it peacefully, to choose our own music to dance to, or our own conversation between us or good friends & family, the sound of our own wine glasses toasting our life that we have made together.

Stalking.. no, I couldn't care less about you! I just know the goings on in "our" neighborhood. I keep an eye on everything, and everyone. Thats what good neighbors in a neighborhood watch community do! I so do miss the good ol' days (pre-villa) when all in our neighborhood got along, and we not divided along the lines of friend or foe of the villa. Maybe after the villa is shut down, things can go back to the quiet, rural atmosphere we once enjoyed.

Unsustained! That’s funny! If all of the annoyed neighbors we were so unsustained, why is all this action that may change the face of whine country occurring? There are about 12 immediate neighbors / property owners that feel this way. Just because they are not able to come to all these meetings or troll the message boards looking to correct untruths, doesn’t mean they are not there. When it is important, they write their letters to those that matter. Why do you care? What is your stake in the matter? Do you want to open a wedding facility out of your house as well? There is only one house closer than any of ours, and the circumstances of that residence and their not being able to hear anything and or mysteriously disappearing during every event... and what may or may not have transpired there is something I don't care to discuss on a public bbs. As for moving away, I do have a life, and it is here, in wine county, I do not wish to leave this beautiful area because of 1 nuisance business attempting to operate in our residential neighborhood. Why don’t you leave if this bothers you so much? All my other neighbors are fine, the view is great, and the market is flat, but I'm sure as with everyone, there is a price maybe if someone knocks on my door with an fat cash offer…I’m outta here – so you just never know!

It is a sad state of affairs when neighbors do this to other neighbors. As a new Temecula resident, I'm disheartened to learn of this instance of putting a small business owner out-of-business. Surely the tax revenues add to the city coffers? Is the Villa licensed? Paying taxes? Welcome this type of service and limit the noise to 10 PM curfew.

Whinecountry, Life is too short to be upset. I too know of noisy neighbors... I live in a an apartment complex full of college students. I could either sit around being upset about the people around me having fun or... I can shut my windows, put on a good movie and forget about it. The events are only held during the weekends and don't go past 10pm GET OVER IT!! The only thing I get out of all your comments is that you are an old lonely grump. Its a free country and you have the freedom to leave if you don't like the situation.

Judge has prevented the injunction. Villa De Amore is in business.
