"On my way in here I finally got a ticket," Ron Muir, a motorcycle enthusiast, said last Saturday as he leaned on the service counter of the store he runs in Old Town Temecula. He shook the piece of paper in front of him. To Muir, the ticket was proof of a problem he had only suspected before. The Temecula police are targeting local motorcycle riders, he stated with renewed confidence. The ticket came as if on cue. He had contacted the Valley News only a few days before about some concerns he had for his fellow motorcycle riders. Muir owns a motorcycle gear shop in Old Town Temecula, he explained in an e-mail last week, and since last month his customers have been complaining of getting excessive tickets. "They say, ‘No, you’re breaking the noise ordinance.’ They don’t have any decibel meters," he said of the ticketing officers. The Temecula Police Department stepped up enforcement in Old Town last month, said Capt. Jerry Williams, the Chief of Police for the City of Temecula. "I got some complaints from some Old Town merchants," he said. "When [motorcycle riders] come through there with excessively loud pipes we will put a few officers down there." He redirected two units – which usually patrol other parts of Temecula – to Old Town for three weekends in September, he said. The officers issued 60 citations, which was "a lot," according to Williams. Temporary increased enforcement falls short of a crackdown, he said. "I ride a Harley myself. Most of my officers ride bikes," he said at a City Council meeting during a discussion of the police department’s activities. "It’s a misconception about the whole thing." This month, the number of officers patrolling Old Town has returned to normal, he said. Nonetheless, some motorcycle enthusiasts speculate the increased attention is part of a larger goal of making Temecula a quieter place. "It sounds to me like [the local police] are cracking down on bikers," said Ken Rauton, the owner of Swing Inn in Old Town. Rauton rarely hears his motorcycle-riding clients complain about getting tickets in the area, he said. Then, in the middle of last month, all his clients started complaining about getting tickets, he said. He thought little of the complaining until he noticed the police Advertisement "You hear a siren going and they got a bike. You hear another siren and they got another bike," he recalled. Some motorcycle riders said Temecula is a choice destination for them and their fellow enthusiasts. "This is what Old Town Temecula is all about: sitting here at Mad Madeline’s, enjoying a wonderful cup of lemonade and looking at the cars drive by. We love it," said Mirna Arenas, a motorcycle rider who came to see the Rod Run last Saturday. Nearly 100 motorcycles sat scattered in various parking lots in Old Town Temecula that night. Though Old Town still appears to be a popular watering hole for motorcycle riders, increased enforcement could change that. When "Temecula" is entered into the search window of www.hdforums.com, a national Harley Davidson online forum, dozens of messages appear. Some of them warn their hog-riding comrades to steer clear of Temecula. "Boycott Temecula, California!" one message reads. The anonymous author of the message, going under the name "ElSexton," complained of getting a ticket in Old Town for having a loud custom exhaust system. "That’s the number one thing you get a ticket on," said Mike Shelhart, a business owner in Murrieta catering to motorcycle riders. He, too, has been hearing complaints from his clients recently of the police in Old Town. His clients have been getting ticketed heavily for making too much noise, he said. At first, Shelhart recalled, he paid little attention to the complaints. Then last month, he was strolling through Old Town when he saw police loading motorcycles onto a flatbed trailer in the parking lot of The Stampede. Last October, the city passed an ordinance limiting the noise people are aloud to make in their homes. The ordinance, however, fell short of regulating vehicle noise. Vehicle noise is already regulated by the state’s vehicle code, Mayor Pro-Tem Maryann Edwards said at the time of the ordinance’s passage. Muir voiced his concerns to the City Council during a meeting last Tuesday. "A lot [of bikers] are afraid to come down here [to Temecula]…they think they’re not welcome," he said. "People need to comply with the law," said Mayor Mike Nagger at the meeting. "Everyone is welcome who complies with the law."

Albeit, there are so many licenced motoristists that are willing to forgo their motorized rights to understand the db law and proper law enforcement procedure. Seems communication (Between parties) on the California Vehicle Code (CDF) has been dimissed? Ie: Street bike db test? Not off road db test, or military db test. This is not a question. Steve says : I don't think the Valley News painted an accurate picture of what's going on. First, this ticketing craze has been going on for a year now, not just the last month. The "biker boycott" has been going on for just as long, and is hurting local businesses. The Chief of Police is actually trying to reverse the situation, saying that his officers misinterpreted his original orders, and went overboard on the ticketing. He has actually told his officers to back off, and use more discretion before pulling over motorcycles. Cops had such a ticketing frenzy worked up, that they were pulling over entire groups of motorcycles, even if they were not making loud noise, and finding any kind of reason to ticket them. One biker told the owner of Swing Inn Cafe, that the cop said, "Your kind are not welcome in Temecula". That's when Rauton and Muir got on the ball, and called up the Chief of Police, the city council, and city manager, and made them reverse the situation. Now, the Chief of Police is trying to get the word out to everyone, that they want all the bikers to come back to Temecula. Valley News also misreported this guy "ElSexton". He was cited for "non-original exhaust", not "loud custom exhaust". That's significant, because ElSexton did not have loud pipes. Temecula cops do not have decibel meters to prove that. They simply look at a biker go by, and make a judgement call, and then bust them for something else. That's the problem the Chief of Police is trying to fix with his officers. 6. Springs says : It's silly for bikers who ride with illegal pipes to complain about being ticketed for their violation of the law. All motor vehicles operated on a public way are required to have proper mufflers and bikers aren't, quite rightly, an exception. All motorcycles sold in the United States since 1983 are required to have an Environmental Protection Agency noise compliance label attached to the chassis at the factory and a matching label engraved on the muffler. It's a violation of federal law to replace the factory muffler with one that lacks the label or to modify the factory muffler to make more noise. In 2007, the city of Denver enacted a motorcycle noise ordinance based on the EPA label system. If an officer hears a loud bike, the bike is pulled over and the usual check for a driver's license, registration, inspection sticker and insurance is done. In addition the officer inspects the muffler for the EPA label and it it's missing, that's the violation. A ticket is written and the biker has two weeks to bring the machine into compliance or pay a $500 fine. This method eliminates the need for an expensive noise meter and training in its proper use. 7. Glacier says : Way to go Slap'n Leather for sticking up for our Brothers and Sister riders out there. Defensive riding equals safety. So ringing out the engine on surface streets with loud pipes is being safe? Really? I guess splitting lanes at 40-50 MPH is being safe too. Dirt says : The group I ride with got pulled over on Labor day weekend, just after leaving the Wine and Beer Garden (We were all sober) we weren't given any tickets but were detained by 11 cops (9 cars) in the parking lot of the AM/PM for about 45 minutes. There were only 3 of us. On the 4th of July a buddy was detained for over an hour. (Again, no ticket) This is the reason we no longer spend our time OR OUR MONEY in Old Town. Unless more of the business owners step up to the plate, we'll continue to go other places to spend money. 13. THERE everywhere, just sitting and a waiting for anyone to do anything. I think they should spend more time by Pechanga and getting all the drunks. How about some dui check points on the parkway. How about patrolling our neighborhoods and our schools. Find something more constructive to do with our money than taking away the revenue that our town needs. RUSerious? says : Come on people, this isn't about loud pipes, this is about Profiling and you know it. Whether the noise level is against the law, or whether or not the cops are just abiding by the law, let's really look at what is going on here. If the police pull over everyone (including those hot rod cars and rice burner motorcycles) then we don't have a problem, but when the only people that get even pulled over are the Harley owners then we have a problem. For those of you who complain about the loudness for whatever reason, grow up! You have loud trucks on the interstate, you have loud lawn mowers in your neighborhood, for goodness sake! You'll find loud noises everywhere that you don't complain about. I'll bet the guy that said his poor little daughter is scared from the noise is the same guy that will take his daughter to the fireworks on the fourth of July and see's her being scared from it too, but he still sit's there and watches them with the noise...double standard? In Oakland, the motorcycle police insisted on having their HD motorcycles equipped with loud pipes because they do save lives. As they say, "people hear us coming now." So let's see, the police can do it but we can't? The Chief of Police himself stated "I ride a Harley myself. Most of my officers ride bikes," but I guarantee they ride with modified pipes but won't give themselves or even their fellow officer a ticket! Double standard? And when the Mayor Mike Nagger said "Everyone is welcome who complies with the law," was saying that he never once broke any law and that is why he is welcome here but not us? What? Are you serious Mr. Mayor? You and your police never once broke any law? I'll beg to differ because as an ex-cop, I know that the police are the biggest law breakers out there! Double standard? And as a Mayor, you should consider all your constituents and you might find that a large of Harley riders aren't the typical outlaw gangs anymore...they are doctors, lawyers, military, and average Joe that vote! Wake up! Pay attention to the things that all you complain about and think for a minute...did I ever break any law...even speeding? If you did and hadn't gotten caught, good for you, but don't complain about some else that you feel is different, because it's not! Double standard? Its bad enough that we are allowing our government to take away our freedom by making us where seatbelts, or helmets on a bicycle (not motorcycle), or "loud pipes", or non-DOT helmet, or whatever else you cows refuse to stand up for! Next thing you know, you won't be able to listen to a radio/music in your car when driving! Believe me, I was afraid of the loud noises when I was a kid, and so were you! Don't use this as an excuse, use it as part of growing up and understanding that loud noises won't hurt you. I welcome the loud motorcycles because I know sometimes when I was driving I almost hit not only a motorcylce rider but other cars because I didn't see them coming, but when I hear them, I take another look and save myself from an accident. The problem here is you know this probably happened to you too! Biker K has made some excellent points and you all should take a good look at what we are saying. What happened to "All men are created equal?" Does this only count for people that abuse the system and don't get caught? Double standard? We've all (including the Mayor) have borken the law in one way or another, so get off your high horse and leave those on the iron horse alone! 16. Ticketed unfairly says : The police in Temecula are way out of hand. While exiting the freeway at 79S off the 15 I was pulled over by an officer who was set up right on the street. He ticketed me for not coming to a complete stop at the light at end of the off ramp before turning right on the red. IT'S A NO RIGHT ON RED LIGHT! I drive this route everyday and endure idiots honking at me when I won't turn right on the red. I had a green light as did the cars in front of me, to the side and behind me. So how do you fight this kind of crap when the city wants money? Since the only people who can afford a HD are lawyers, anyone want to find out how much ticketing has gone up in our town? Noise is a matter of what one thinks it is. The police is only on personal judement with no formal training on a db meder. I spent two years in noiseabatement training and I fine noise level in town is higher in meetings at a contuious level. I will always tell my group riders to stay away. 21. I saw an episode of Jesse James' show where he was getting off on aiming the pipes right at the drivers side window of any car unlucky enough to find themselves next to him. Kudos to Temecula; come on Murrieta time to follow suit! 24. lori says : i have lived in the temecula/murrieta area since 1986. i have gone through old town many times and i have never once been disturbed by any of the bikers and their so called "noise". i am not a bike owner myself, but i know that the people who ride their bikes to old town to spend a day of shopping and eating at any of the restaurants are brining in revenue to the city of temecula. and during our economic crisis i would consider this being a welcome sight to the city as well as the shop owners in old town. so maybe everyone should look at the whole picture of what the bikers are doing for temecula. and keeping people employed. think about the single parents who have to work two jobs just to make ends meet for their families. take away from people who are coming to temecula to shop and eat you are taking jobs away from others, because businesses are closing every day and people are losing jobs every day. so that comment would really be for you too murrieta mike!!!!! why take it to hemet and give them the revenue!?? i have never ever once since 1986 seen a biker being unruley or causing any problems. they are their to enjoy a much needed day off, a day of freedom on their bike and a day to visit with fellow riders who enjoy the same passion. i see nothing wrong with the police officers going through town themselves to patrol and keep an eye out for the town, but to segregate bikers from any one else is wrong and if people don't like the noise from the bikes, why do they enjoy the rod runs so much? why do they not complain when hot rods come through town?? get real people...think of the economy and remember...we are all proud to be americans and live in a country where we are free to enjoy ourselves and ride our harleys or drive our hot rods and not be bothered by the few that don't like the noise. i might add, out of the 22 comments only 4 are people complaining about the "noise". what does that tell you!!?? it only bothers a few...not many!!!!! 25. Grumpy MC says : I've been reading all the comments as they been coming in. I have a business building custom hotrods and motorcycles.All my customers enjoy the sound their rod or bike makes when cruising the highways or through town. The sound is a American icon whether it be a 1930 model "A" with a built flathead or a brand new Harley. It's the sound of power that drives us. Remember when we were all kids and loved the sound of that speeding freight train,well we never grew up and these are our trains.I ride a bike every day and visit old town several times a week I have baffled drag pipes that are loud when you open it up and a nice rumble when cruising. My 11 month old grandson knows when grandpa's coming to see him. I've never seen any one zooming through Old Town. That's impossible because it's always crowded. I think we are some of safest drivers on the road. We don't talk on cell phones, eat cheeseburgers or put on makeup while driving. We have to be aware of that vehicle beside us, in front or behind us. I checked the current CVC book today and a motorcycle 1986 and newer can be at 80 DBR. That's almost as loud as that freight trains' horn. these are the facts. Ride hard and Ride long and God Bless America. 27. Dirty Dave says : Its all about shooting the fat hog. ( no pun intended) The city wants in on all the action in oldtown, so we are forced to pay the extorsion. Some of my brothers were recently shook down in Lake Elsinore and they fought every helmet & exhaust ticket and they won. I think if we all boycott old town they will be begging us back. Are you serious? 29. lori says : ruserious...i have heard cars and rice burners louder than a harley. many times i have sat at a light and a rice burner comes hauling butt between cars and the noise scares the crap out of me. and i have sat next to cars that rumble so much my truck vibrates. i have never been startled by a harley. and yes, there are some harleys that are loud, but going through old town they aren't loud. they are just humming through since old town traffic is always at a slow move!!! 30. Mike says : Great comments, ALL of you. Free speech is a right and going on all around us. My take on this is that Old Town isn't the big issue. The real issue is Temecula and its police force. Don't just boycott Old Town, take all of your business outside of Temecula. Don't put on any runs that stop in Temecula and don't support any runs in Temecula. Tell HD and all the other shops in Temecula why you are taking your business to other towns and get your parts online. And tell your friends and be sure they tell their friends. Write your biker magazines and papers and websites and pass the word. If you live in Temecula, write your city council and your chamber of commerce. The thing that is problematic about suggesting a boycott of all Temecula is that the results will be diffused and the city council will just say it's the economy. Imagine if the Promonade mall starts calling the Council and complaining that THEIR sales are down drastically because of the Councils Profiling of motorcycles. THEY WILL LISTEN to these big retailers, not so much to us little guys. So doing what you suggest, i will lose my house and my dream. There is a lot at stake in all this. The city will keep going!! I am sure the police will keep going, but the business owners that you are suggesting to boycott out of Temecula will be the one to suffer. Maybe your employer will let you work 40-60 hours a week , but cut you a paycheck for 5 hours of pay. Hey Mike think about that!! Thanks for your time!!! 33. Vinny says : My husband, a retired NY Firefighter, and I fell in love with Temecula while visiting our son and moved here a little over a year ago. We were so impressed with this beautiful city and all the wonderful things to enjoy here--like wine country, the parks, mall and--our favorite--Old Town. As Harley riders we were very happy to find a Harley Owners' Group at Quaids so that we could join with other bikers who love to ride and promote charity events. We were heartbroken to learn that the City of Temecula has declared "war on Bikers" and has been singling them out to receive tickets when they try to visit Old Town. The issue seems to be the fact that some merchants are offended by pipes they consider "too loud"! Perhaps they are unaware that most motorists are so busy dialing their cell phones, texting or playing with their boom boxes that they are often too distracted to notice motorcycles around them. We have been cut off and nearly killed on several occasions by these distracted motorists especially in Old Town where they are relaying the sights to friends via their cell phones!! Why isn't the City Council or the Police concerned about protected us from them?? I have yet to hear of anyone being killed or injured by loud pipes but I have heard of many bikers being killed and injured by distracted motorists using cell phones! We don't have very loud pipes but hope that at least they are loud enough to be heard by those drivers whose eyes are on their phones and not the road. We and mostly all of the riders we know are very considerate when riding near pedestrians and horses and would never use our bikes to be disrespectful or inconsiderate of those around us. We are very sad that we can no longer ride through our beautiful Old Town because of this harrassment and we are ashamed that our beloved City of Temecula would single out bikers for harrassment just because of the complaints of a few merchants. Do they have any idea how much money these bikers were bringing to Old Town by eating, shopping and supporting activities? What about the friends we used to invite to show it off to them? We did notice that cars with very loud mufflers and boom boxes have not been part of this "crackdown". We are law-abiding citizens and would like to have the freedom to ride our motorcyle wherevever we choose without fear of harrassment because of the actions of a few. We would like to suggest that the police direct their efforts to enforcing the cell phone laws and other dangerous activities and let the bikers enjoy Old Town once again. Until that time, we and our fellow bikers will be spending our dollars in outside of Temecula in areas that appreciate our patronage. We ride with businessmen, firefighters, law enforcement officers, doctors, lawyers and other upstanding citizens who are also equally upset about no longer being welcome in the City of Temecula. 34. Case and point there have been several reports of Temecula’s finest telling bikers that they are not welcome in Temecula. That does not sound like miscommunication that sounds like following orders. So the police succeed in cutting down the number of motorcycles, and all of the sudden businesses start to realize that we spend money, a lot of money in Old Town and want us back. This harassment has been going on for years, especially to those of us how choose to be in motorcycle clubs and wear a patch. The last Rod run I had a friend told to take off his jacket, leave Old Town, or go to jail. I am a member of one of the oldest Motorcycle Club’s in the world, we started up in 1946, and we are not and never have been involved in criminal activities. Yet when I wear my club jacket 8 time out of 10 I will be stopped when I go to Old Town, even if I am not on my bike. I was even hassled when I took my 6 year old son down for some root beer. It is really sad that a law abiding, tax paying, local small business owner, and home owner of ten years has to endure this on a regular basis. I personally am going out of my way know to spread the word to boycott Old Town Temecula, I will do this with printed fliers, web boards, and word of mouth, until I see or hear an apology from the Temecula police, sheriffs, and the gang task force. 38. In reading the article that Wednesday I was happy yet saddened at the same time. I have been riding since about 1974, and my 74-year-old father still rides in the wind today. It’s been quite awhile that I’ve thought about writing both the Modesto Bee and the Oakdale Leader in the honor of motorcycle riders with or without patches on their jackets or vests. I truly hope each and everyone that reads this has a much better understanding of Motorcycle clubs and their way of life, Harley riders and club members alike. My personal experiences come from the Silicon Valley/Bay Area, through the Central Valley including meeting many others from time to time around the States. These Motorcycle clubs are Men’s clubs no different then the elks, the Lions club or the moose lodge, even somewhat like the Clampers, which are very well known. Although I must add, you don’t have to bring your Liver to a motorcycle run like you would a doin’s at a Clamper function (sorry guys) They have family’s they are great parents most have average salaries between $42,000.00 and $78,000.00 a year, most of them DO NOT drink, or do drugs, and if in fact if they do have a few cocktails, do have a designated driver. Most I would even describe as workaholics, they have tattoos that simply symbolize their individualities “the love of artwork no different than artwork some love in sculpture, or paintings. These men and their women have pretty high standards when it comes to respect, morals, and values that we were taught as children, and still hold with us today. Let me clear up a few things here first of all there is good and bad in everyone, in every field, organization, and Government. There are good and bad doctors, lawyers, bikers, and ‘yes even Police Officers, sadly enough more times then not. It’s appalling to me that it has even come to a point that at times children are afraid to approach a Police Officer because they are frightened with some of the things they have read, or have even witnessed. Again let me point out this is NOT a letter bashing Police Officers! I have met some very down to earth cops as well, the ones that went into their fields for the love and safety of people, however I have also come across kids that went all the way through the Police Academy, then decided not to go into the field because of politics, the stand by and back your fellow officer, wrong or right. Here are some things to ponder: Most bikers including the Hell Angels do not start fights or get into confrontations; in fact they try hard to avoid it altogether, but they are certainly not going to back down from any wrong doing in the areas of injustice, or disrespect. I can assure you that if your 70-year-old wife is stuck on the side of the road it will be the big hairy biker that will come to her aid before most anyone else. I can also assure you that our neighborhoods are significantly safer with a biker on your street more so then not. I also want to point out the large amounts of money these clubs raise every year for all kinds of benefits, mostly favoring those that involve children. The parenting skills of these gentle giants are unbelievable, they stick to their guns when comes to the rules, you will never see the out-of-site out of mind motto in these families. They do not go on vacation to the Bahamas and leave the house to the kids to have free range, they have strict rules, because they have seen first hand the far from perfect world we’re forced to live in today. They are family oriented, territorial and protective of the ones they love, “and that my friends is the way it should be! The kids of these family’s are taught wrong from right, to treat people the way they would want to be treated. We talk to them about life we tell them that sometimes the person you least expect to hurt you probably will, that two wrongs don’t make a right, that money doesn’t by class, and yes how to protect themselves in the far from perfect world we live in today, and that you can’t judge a book by its cover. Bikers give their kids a day “if you will “ they are old school boys, they spend time with them, they don’t buy them a car they help them build one, and they had to have earned it... I beg each and every one of you, hopefully reading this today, Police Officers as well, to take a real good look at today’s new generation of parents, and adults, they may appear quite a bit more conservative looking but looking a little closer, underneath you may find this doesn’t make them any better at parenting, or a better person. If you could find the time, and have the respect to get to know one someday, you’ll find that they help more so then hinder our community! My wish is for all of you to look beyond this rugged exterior so that you will have a true understanding, and find they are more of a benefit to our society much more so than a burden. For God sakes let’s stop the subjectiveness, the status quo image, the biker trash theory you have been lead to believe for too many years now. I can list many things to center your attention around in areas of crime, drugs, drinking and driving. Please stop wasting your precious time, and our tax dollars on hassling innocent Bikers, and or Bike Clubs and their families. There are so many other things Law enforcement can focus their attention on in these areas. EXAMPLE: look at our 20 year old and under crowd, there, without a dought is more trouble during spring break, and rodeo weekend then there are at any Biker rallies! And this my friends is a fact. Please remember the Oath you took to serve and protect! NOT to discriminate, or place judgment. Remember our constitution, and the wise words of our forefathers, now rolling in their graves. The wisdom of these men on freedom of speech, freedom of choice, and the security we should all have in our own homes. Life has put all of us through test after test; please let our Motorcycle clubs and their members raise their families in peace, without the fear of being criminalized by society, and law enforcement alike. It’s hard enough to teach our children morals, values, and respect these days. After all it’s the constant harassment placed upon our bikers that has forced them into watching their backs, not placing much trust in mankind. Unfortunately society and Law enforcement alike have played big roles in placing this burden upon them. I would hate to think it’s come to cops against bikers instead cops against robbers. Which reminds me of Two Motorcycle clubs, Wind And Fire is one of them, they’re firefighters that get along just fine with the (so called) outlaw bike clubs.
