MURRIETA - A preliminary hearing in the case of three men accused of fatally stabbing a local pastor's son and injuring his friend was delayed today because the former girlfriend of one of the defendants had issues with self-incrimination.
Matthew Alexis Basler and James Wing Fung, both 31, and Marvin Justin Black, 26, all of San Diego, are charged with murder in the Dec. 26, 2008, stabbing death of Chapman University student Ryan Joshua Armstrong, 22, and the attempted murder of his friend, Joel Ross, in an alley behind E.T.'s Bar in Temecula.
Basler and Fung are also charged with trying to prevent a witness from testifying.
Today -- the second day of a preliminary hearing that began Dec. 12 --witness Casey Grove was about to testify for the prosecution when a defense attorney brought up the issue of self-incrimination in the case.
Grove, who was Black's girlfriend at the time of the stabbing, allegedly drove the truck that took the men away from the scene.
She has not been charged in the case but has not been granted immunity, either.
Riverside Superior Court Judge Timothy Freer ordered a conflicts defense attorney to examine the case and counsel Grove on whether she should testify, and delayed the preliminary hearing until Feb. 18.
A preliminary hearing is held to determine whether the evidence warrants a trial.
The victim's father, Ron Armstrong founded the Cornerstone Community Church.
Suspects caught in pastor’s son’s murder
Police have caught two suspects for the murder of a local pastor’s son. On Dec. 29, police arrested Marvin Black, 25, and James Fung, 29, for the murder of Ryan Armstrong and the attempted murder of Joel Ross outside a bar in Temecula. Police are still searching for another suspect, Matthew Alexis "Matty" Basler, 30. Basler is a white male approximately five feet, nine inches tall with dark hair and a tattoo reading "Anita," on his right ring finger. Ryan Armstrong was the son of Ron Armstrong, the founding pastor of Cornerstone Community Church in Wildomar. Joel Ross, the son of Hugh Ross, a well-known creationist author and minister based in Los Angeles, was also attacked. Though badly wounded, Joel Ross survived. On Dec. 31, the Riverside County District Attorney charged Black and Basler Advertisement
[ Murrieta Volkswagen ] with murder and charged Fung with attempted murder. The Southwest Detention Center is holding Black while a San Diego County jailhouse in Vista is holding Fung. Both suspects have extensive criminal records, according to San Diego court documents. Since 2001, the San Diego District Attorney has charged Black with two felonies: stealing a vehicle, for which he was sentenced to serve eight months in prison, and assault with a deadly weapon, for which he was sentenced to two years in prison. In addition, the DA has charged him with two misdemeanors: vandalism and battery. Since 1997, the DA has charged Fung with five felonies and five misdemeanors. The felonies include assault with a deadly weapon, drunk driving, writing bad checks, possessing controlled substances with the intent to sell and possessing controlled substances while on parole. The misdemeanors include drinking in public while under the legal age limit, trespassing and starting a fire, cutting telephone or electricity lines, driving under the influence and buying stolen property. Fung has been sentenced to serve time in prison on at least four separate occasions for periods of time ranging from 180 days to four years. All three suspects are from the San Diego area. The murder The murder took place on Dec. 26 in the alleyway behind E.T. Lounge, a bar in the 27000 block of Jefferson Ave. in Temecula. Witnesses told police investigators the events leading up to the attack started with an argument between Armstrong and Ross with Basler inside the bar. Basler attacked Armstrong and they began to fight, according to a police press release. During the fight, Armstrong and Basler moved into the alleyway behind the bar. There, somebody broke the fight up and separated the two men and Basler left the bar. A few minutes later, a truck pulled up to Armstrong and his party. Basler emerged from the truck along with Black and Fung. Another fight ensued, leaving Armstrong and Ross suffering from severe stab wounds. Police got a call from a female at 10:45 p.m. reporting the stabbing. At 11:28 p.m. Ryan Armstrong was rushed to Inland Valley Regional Medical Center but was pronounced dead. As of Dec. 28, Joel Ross was expected to recover. No further information has been released about his condition.

I knew Ryan. I went snowboarding with him once. He was a bright, funny, and promising man. I hope justice serves the man who took his life. May he receive mercy from his maker. However he no longer deserves to take up space on this planet.

Ryan is the same age as one of my sons. In fact they were good friends in Junior High and Ryan is remembered by our family with love. It is so sad to be so alive, smiling, speaking, interacting with others, and then to be still and without breath. Hearts are broken, but the one "sure hope" that sustains those of us Christians who miss him, is that he is actually very much alive. You can't kill the spirit and though the concept is foreign, death for the Christian is the ultimate victory. That truth does not remove our sadness which is deep and heartfelt and we sincerely come alongside his parents, brother and family praying for strength and supernatural peace during this time.

I have known Jamie Fung since the 7th grade. We were close in our early 20's. I am in shock over this. I stopped talking to Jamie years ago because unlike Jaime, most of us grew up and stayed out of trouble. I never imagined I would see him in a murder headline one day. I can not believe I was once friends with a person capable of something like this. How scary to think I allowed this guy into my home and hung out with him almost on a daily basis at one time. The Jamie I remember... Well, he had a lot of us fooled. I just can't believe it.

I agree, I hope that the third suspect is found and a speedy trial is executed. Let's hope our legal system executes justice this time. Prayers for Ryan's family.

Your "facts" are incorrect. Joel Ross never spoke a word to Basler, and there was no fight that "moved into the alleyway." Please be more careful in checking your information sources.

If you people only knew the people who are being accused of the death of ryan, you would know that they are great guys and dont run around hurting people for no reason at all. What because ryans father holds a title in a church, ryan is some perfect saint? I'm sorry that this boy lost his life and family has to suffer from it, but ryan took part in causing the problem. He didnt wear a hailo of gold above his head. He to made the choice to fight another person, follow my friends out of the bar and continue egging on for more battle. So before condeming my friends open your eyes for the reality that ryan caused a problem and wasnt a silent little field mouse sitting thier being picked on by the local bully.

Reality, I have read the story, and I do not know any of the suspects nor did I know the vicitims; but from what has been released to the community, the suspects have had a history of violence (both of the two who have been caught, have previously served time in jail for assult with a deadly weapon). I agree that Ryan may not have been all innocent in this situation, but there is no reason for anybody to kill another human. It is wrong on so many levels. From what I have been reading, I do not hear nor see where the two suspects were stabbed either to death or to cause any injuries. They are at fault 100% and hopefully will be taken off of our streets. These men may be "good guys" in your opinion of a good guy, but they have made many wrong choices.

Fighting is one thing "Reality", killing is another. No matter who it was that was stabbed to death, whether it be a Pastor son or the ones accused of the murder, Ryan did not deserve it. Were you there when this all took place? If so, hopefully you gave your version of the story to the investigators. If not, you are only hearing your friends' side of it. And what does it say about you who keeps company with these guys that have been charged with felonies in the past and served time for it???

Dear Reality, the murder trial will reveal the truth as to whether these gentlemen are guilty. We know ryan wasn't as saint but he is the one dead from a knife wound to the heart and another is in serious condition with stab wounds as well. Maybe Ryan and his friend simply fell on the knives by accident. According to the papers these men who are in jail without possibility of parole have criminal records and are charged with murder and attempted murder and could face the death penalty. Maybe the police have made a huge mistake and these fine youngsters were not even involved and will eventually be free. The trial will tell whether these men are freed, die or spend many many years in jail. You just hang in there.

marvin is actually one of my best friends. ive known him for years. everyone that knows him knows that he is a little hard headed but in no way is he a murderer. im not saying ryan deserved to die, but the truth is this guy ryan who died, instigated the fight that eventually led to his death. my prayers are with ryans family. but i ask the question.... what kind of son of a pastor goes around getting into bar fights?

Dear Reality...no amount of egging on or teasing as you claim is enough to bring the good ole boys anger to the point of using deadly force to protect their honor!?! "Great guys" in your family prone to the use of deadly force if ticked off? Ryan was not "a pastor's son" to me. He was a kid just like you and I pray for protection over you if this is the "great guys" you have in your family.
No Christians are perfect and NONE have halos. WE are all humans and children of God. I am truely sorry for your families loss. I have been praying for Matty, Marvin, and Jamie since the night of this sad event. I pray for closure and reconciliation for all.

Reality wake up and shut up! Wether or not Ryan (who I dont know) was involved willingly or not in a fight the accused and now arrested on murder charges used a weapon and killed a man. Who carries a large machete knife around in their truck and pulls it on a fight anyway? Your stupid murdering friends could have drove away. No one made them fight. I mean just look at their mug shots. It doesnt take a rocket scientist to see these guys were losers! Wether Ryan provoked, participated in the fight or not it doesnt take away the fact that he DIDNT use a weapon, but YOUR friends did. Justice will keep these murderers in prison for a long time I hope.

The article describes Marvin as having an extensive criminal record. Now if you are Marvin's "best" friend maybe the police need to ask you where you were on the night of the assault. Your "best" friend? I mean is that the best you can do? He took a knife and killed someone. He brought a knife fight to an alleged fist fight. What a coward! Being a pastor's son doesn't gain ryan any points but does it mean he deserved to die because he doesn't fit your description of a pastor's kid? Actually, your best friend is a murderer if he took out a knife and stabbed someone to death. Did your friend do that? Then he is a murderer. If he didn't, then he is not. It doesn't matter if Ryan instigated the fight, because fighting with fists is not a big deal. They happen all the time. But everyone CHOOSES to become who they are. I saw Mr. Black in his Orange two piece set meeting with his attorney yesterday. I am a pretty good judge of people and think he is guilty of being a jerk but not murder.

I've grown up with Marvin from a early age. I know one thing he would never murder anyone. My heart goes out to the family of the kid that was killed and also the other boys that were stabbed. God is the only one that knows the truth and i believe he will show the truth in time. My prayers are with my best friend Marvin even if he does get time i will stick by his side till the end with prayers and letters to him always!!

Yesterday I attended Cornerstone church for the first time and I watched Pastor Ron provide the church community with a wonderful service. I had no idea what pain and loss he was suffering through until the end. The faith and belief this man has is amazing. For him to have lost his son 3 1/2 months ago and still stand tall and proud with faith just gives me goosebumps. This family should never have had to go through this and they make me want to strengthen my own beliefs and relationship with God. My whole family felt this hope and power and we will pray for him and his. Jamie Fung may have been your friend but he made his choices. Ryan didnt choose to die.

It is almost laughable to read what some of these people are thinking. Ryan was a great friend of mine. Great. What happened to him was ridiculous. The three "boys" involved deserve whatever happens to them. I think it is great that their families are backing them 100%. They are going to need it. For those of you who seem to be confused, let me help... Ryan and our friends were at a bar, someone made these "boys" mad. Ryan tried to clear everything up. Ryan bought them a round to clear the air. Ryan and our other friends stepped outside. The previous "boys" left the bar and then came back, to the back alley. They then thought it would be a great idea to slaughter two young men. Ryan, that sweet boy didn't make it. Joel, a great friend, did.
So, as stated, some of you are going to need a lot more than support. some of you tried to play God and now you will be punished for it. If you're going to fight, then fight like a man, have a fair fight. Who brings weapons like that around in the first place, then uses them again and again on a human being. I feel very sorry for the families involved with this, your "friends" are pathetic. Absolutely, disgusting and pathetic.

it seems to me that its a case of self defense and not murder.When 15 to 20 people jump some one that they have to defend themselves and that was the case. now i want to know is why all the bad as*es that jump fung black and basler didnt try to prevent the whole mess if ryan hadnt started this whole mess none of this would have happened.ryan and his friends wanted to act tuff because they were alot of them jumping 3 people,not so tuff now

if you had a any bit of intelligence you wold realize that the people that stabbed ryan and joel were not good people and did make a big mistake by not getting in their truck and driving home. Wow.. reading what everyone has writen throughout this past year is truely astounding. Ryan was a beautiful individual with the world ahead of him. Whether or not he instigated a fight, he did not grab a weapon and premeditate the murder of someone he didn't know. These three idiotic and morally crippled young men did. Fighting is fighting. Waiting in your truck outside of a bar to kill someone is a whole different ball game. And all the comments of "oh marvin is my friend, matt is nice, and jaime just has a heart of gold" is bull shit. They are murderous basterds who deserve to rot in prison. I'm sorry you have friends that are sociopaths but they will get exactly what they deserve. Watching a family fall apart and have to pick the pieces back up really ensues a lot of sympathy for these guys. I just wish that the so-called "besties" of these guys could see the pictures of what they have done. There was a million witnesses and tons of damning evidence. My son and Ryan were good friends, they grew up in church together. Ryan was at that bar to celebrate a friends birthday and had not been there long. Fung, Black, and Basler got pissed off at him for one of the girls in Ryans group setting a beer on the edge of a pool table!~ Does that warrant taking his life? I think not! Ryan and his group left the bar, went out to the back in the alley where they were parked, and The hoodlums followed them back there. They were not parked in back, they intentionally drove back there! Ryan was a good kid making something of his life and it was stripped away from him by 3 cowards! They will get their just due, but it's sad how in the meantime the Armstrong family has had to suffer this loss! I pity those of you who were friends with these three guys if you call them "good guys"! Bah!!

He didn't call the cops because he was bleeding from his head and eventually passes out from blood loss. So sorry he wasn't able to help the injured party but he was a little busy having his d... head smashed into the ground. As for ryan dying I'm sorry that happened to him. Wow I just saw this story and can not believe it! I cant even imagine what it must be like for the Armstrongs! I hope these guys get life in prison or better the death penalty. These guys are some of San Diego's biggest losers. I can't believe they were let out of prison before with their previous charges. I have heard that Jamie Fung has done many criminal acts in his life. Not just the one's on his criminal record. In the many years I've known him he's been arrested upwards of 10 times, gotten away with three times that many crimes. Many of them petty, but the escalation of crimes was obvious to those of us who stopped hanging around him. He has restraining orders, committed arson, stabbed an animal to "see what it felt like", multiple drug arrests and been arrested for assault. I feel for the victim's family. I also feel for Jamie's family. His little brother is an amazing person, his mom a sweet lady, and his dad was a exceptional officer of the law. I hope justice is served, but nothing brings back a loved one. Both families are devastated, many more friends are saddened.

To Pissed, I've known James Wing Fung since the 3rd grade. I stopped hanging around him in our early 20's because of his lack of morals and compulsive lying. The animal he stabbed was a potbellied pig of a mutual friend. The things he did were either witnessed by myself or other mutual friends, or bragged about by Jamie. I wish the kid I knew from elementary school on past high school didn't do these things, and that Ryan Armstrong's loved ones didn't have to go through this. But it happened, and that's the Jamie Fung I knew.

I feel sick reading these comments. Last weekend I was with Ryans parents and brother. I'm an Armstrong. Proud of it. I can't really manage to type any words but I want to sat thank you to those who are praying for our family and refuse to let people judge Ryan for being a pastors son. I'm a pastors daughter, my dad is Ryans dads brother. I don't understand the mind of someone who can talk bad about a murder victim. And why the hell does it matter what his dads occupation was?
Those defending the accused, I understand they have families destroyed because of their choices. But at least they get to visit their sons, brothers, cousins in jail. Ryan is gone. I'll see him again when I join him in Heaven. But while your busy defending them, we are trying to figure out the best way to celebrate Thanksgiving as a family that feels shattered. Whoever stole Ryans life will never know how the deep pain caused.
I forgive whoever did it. I ask that no more comments be made about Ryan unless you knew him. Say whatever you want about your family and friends. But unless your speaking out of respect and genuine sympathy do not even type his name. Do not even say it. You don't know the man you speak of. And if you did, you would only be able to weep at the thought of a world existing without him in it.

actually I grew up with Matt and believe it or not at one time he was a promising young kid who had a big heart and big dreams. Due to drugs, parents who didnt care about him, more drugs and the influence of others around him he fell victum to becoming a product of his own envornment. You can never value anything in this world over human life, from an ethics stand point people must have a system of beliefs which make them good human beings, otherwise you will never be anything in life. Matts entire life has been accompanied by a sad story which I am sure most people will never really know of or care about. In my eyes Matt just needed a role model and to stay away from drugs and situations like this one. I wish everyone the best outcome in this, the family whom have lost their loved ones. And also that justice is served, if Matt is innocent than I hope he gets free. It is not up to anyone to say who is at blame or is not. Its up to the Judge and Jury. It is interesting to me that no one writes anything here about Matt, believe it or not he has people who care about him as well...Its too bad. This entire thing is dissapointing and very sad.

well stated reply and I think that it is sad that all of this happened. I knew Jamie when he was a kid. He was voted most talented in middle school, and was a pretty good athlete too. But something always seemed a little wrong, he always pushed the boundaries just a little too far. This time I think everyone loses, some a lot more than others.

i spent a few months on a mountain top in rehab with jamie right before all this happened. i didn't know him before this. but he was strait out of prison and even coming rite out of prison jamie was a really nice guy he does have all the prison tats but if you look closely there blind skateboarding company and stuff like that ha and he told me lots of story of crazy stuff he did..we also spent 14 hours washing 1000 cars for free to raise money for our church this was literally a month before all this happened....I don't doubt that everybody there that night was involved and probably did stupid sh,,,. but again i don't think he was trying to kill anybody maybe have the upper hand in a fight..

JD, there is no excuse for your friend stabbing somone and leaving them to die in the back of an ally. All three of these guys commited a horrific act and fled to san diego, not one called an ambulance or the police. You can have" nothing but love for your friend" all you want, but the truth is your friend willingly participated in the stabbing death and then left the scene........Now he has to learn how to live with that forever and he has to answer to god for the crimes he's committed. I am so glad the trial has finally started. I cannot wait for these 3 to rot in prison where they belong.
Ryan and I were never the closest of friends. I attended all four years of high school with him. In a graduating class of 21, you tend to get to know your classmates like family. Finally, during senior year, we had a mini breakthrough and became somewhat close, due to having the same rough Honors classes and dealing with the same teachers and homework. We even "battled" over the Valedictorian spot in our graduating class. As smart and as talented a person as Ryan was, he was awarded the honor. I was happy to have also given a speech that day alongside Ryan as the Salutatorian. Ryan was your typical HS boy. He did stupid things and he went through the phases every boy does when becoming a man. After graduation we all went our separate ways and I never spoke to Ryan again.
I will not sit here for one minute and say that Ryan was perfect because I know for a fact he wasn't. No one is. If Ryan threw punches, he threw punches. But he did not pre-meditate a murder. Is Ryan or any of his friends at fault for ANY of this? No. I don't feel that a glass left on a pool table or even a few punches thrown should cause one to lose his life and many others to suffer physical and emotional pain.
I also knew Chris Martin, who also went to HS with us. Again, he did his share of goofing around and did the things typical HS boys do. However, he does not deserve any of the repercussions of this situation. No one should have to go through something like this... watching their friend get stabbed to death as they are helpless to stop it.
These 3 little boys had to prove their masculinity by being "stronger" than Ryan. They had to prove their dominance by using force, coercion and defense tactics. They had to prove their idiocy by ending the life of a promising young man and injuring so many more. I truly hope they spend the rest of their lives in prison for this. The thing that hurts the most for me is seeing pictures of these 3. They seem to have no remorse over anything they have done. There could never be enough justice done for the Armstrong family. Pastor Ron was my Pastor for many years and I felt like a part of his family both at CCS and at the church. My prayers continue to be spoken for the pastor, his wife, and Ryan's little brother Ross, who lost not only his brother but one of his best friends.
RIP Ryan... you are truly missed.

Prior to the day of the stabbing, Black and Fung had a strong history of being incarcerated PERIOD. Those of you that carry on about how good of a person Black and Fung were are seriously unaware of who they truly are. I hate to say this but yes they are known criminals that have been in the system way long before the stabbing. Court appearances clearly show that they have no remorse what so ever for Ryan. Photos in the news paper show Black and Fung smiling when you know deep down inside they are truly miserable being locked up like animals. Oh how they must be so proud to wear them bright orange jump suits that clearly advertise them as being the property of Riverside County. The truth will prevail for those of you that are in denial, keep visiting them in jail because that is as close as you will ever get to Marvin and Fung. When the guilty verdict comes in better pack your bags because its STATE PRISON from there on and I can reassure you it won't be no where close to home.
