MURRIETA - Four alleged white supremacists accused of beating a Latino so badly at a Hemet trailer park that he suffered brain injuries must stand trial on felony charges, a judge determined today.

Justin Tyme Hayes, 21, Derek Shane O'Brien, 23, and Scott James Siewert, 23, all of Hemet, are charged with attempted murder and active participation in a criminal street gang.

They face 18 years to life if convicted of all charges, plus great bodily injury, serious felony and gang-activity allegations.

Mark Anthony Wisler, 17, of Hemet, is charged with assault and membership in a criminal street gang and faces eight years in prison if convicted of all charges.

The four allegedly belong to a Hemet white supremacist gang that commits crimes, according to Hemet police Detective Takashi Nishida.

They are suspected of attacking an 18-year-old Latino Nov. 18 at the Jackson Mobile Home Park at 225 Elk St.

The teen was in a coma for months and is still recovering from his injuries and getting therapy, police said.

Siewert's attorney, Jeff Zimel, said his client did not intend to commit murder, and that he thought the victim had burglarized his vehicle.

"At most the crime that was committed was a 245 (assault)," said Zimel. "The evidence is that this was a spur of the moment explosion of violence."

Deputy District Attorney Timothy Cross said the attack may have "started out ... like a burst of violence," but after the victim ran, he was chased down and beaten by Siewert and five others. "They're kicking him hard and multiple times," Cross argued.

In deciding there was enough evidence for the defendants to stand trial, Riverside County Superior Court Judge F. Paul Dickerson asked Zimel if lifting one's foot and stomping on someone's head might not be construed as an intent to commit murder.

A fifth defendant, Crystal Lee McCann, 22, pleaded guilty to a witness intimidation charge and was sentenced to probation.
