TEMECULA - A 59-year-old man suspected of pointing a gun at a girl selling cookies when she knocked on the door of his Temecula home was arrested today.

Officers were called about 11:25 a.m. to the 31000 block of Strawberry Tree Lane to investigate the assault-with-a-deadly-weapon report, said Riverside County sheriff's Sgt. Daniel Decker.

the victim knocked on the suspect's door, he opened the door and pointed a gun at her."

The girl's father, who witnessed the incident, called police, he said.

The suspect, identified as John Dodrill, was arrested and the weapon seized, Decker said.

He was being held at the Southwest Detention in Murrieta in lieu of $25,000 bail and was due in court on Wednesday, according to sheriff's online jail records.

The legal definition goes something like this. Assault is threatening someone or making threats. Battery is physical contact.

I have a problem with this arrest with bail set at $25,000 and confiscation of a gun. Could he have looked out and saw a strange man (the father) at his door so he opened the door armed? Nothing was reported that he made any threat other than being armed when opening the door to a stranger . Is it a crime to possess a handgun in your own home? I would be interesting to get all the facts.

Proud member of the Temecula Tea Party Patriots, standing his ground against cookie-purveying evil-doers! Penal Code Section 240: "Assault is an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another."

Prof B of LA, could you please define what the "unlawful" "attempt" is with the facts presented in this news item. You seem incite emotions with facts like he is a Temecula Tea Party Patriot though it has little relevance. Does your source say he was arrested for assault as you have defined or could it have been an arrest for brandishing a firearm. Relevant facts please.

Aside from all the inflammatory comments about the TP, etc. facts suggest this man may well have violated the law. Assault encompasses a threat of bodily harm, be it actual or constructive bodily harm. In this case it was constructive as a weapon was involved but an assault looks like it was committed here. It's really surprising the event occurred where it did. It's a nice neighborhood. Very quiet. But I guess there are all kinds of people out there and any neighborhood can harbor folks like the defendant.
